Forever Chemical Contamination (MDL 2873)

PFAS, also known as “forever chemicals,” have contaminated water systems, land, and infrastructure across the U.S. These toxic substances are linked to serious health risks and steep remediation costs.

Through Multi-District Litigation 2873, a federal lawsuit pending in U.S. District Court, public entities can pursue cost recovery for mandatory cleanup, testing, and long-term water treatment. Partial settlements have already been secured against manufacturers like 3M and DuPont.

The EPA finalized enforceable limits on six PFAS chemicals in April 2024. All public water systems are now required to monitor for these chemicals by 2027 and take action to reduce them by 2029 if levels exceed the new standards. If not addressed, this could become a significant taxpayer-funded burden.
